These General Conditions govern the purchase of products and services carried out remotely via the Internet on the website “www.industriemarine.it”, owned and with registered office at:

The following General Conditions of Sale form an integral part of all our supply contracts of materials through the website.

IMC srl manufactures and markets the products listed on this website, addressing professional/business customers and end consumers. In the latter case (a natural person acting for purposes not related to any professional activity), the relationship between IMC srl and its customer shall be governed by consumer protection regulations, Legislative Decree of 22 May 1999, no. 185.

The customer, if qualifying as a “consumer” as referred to in point 1 and with reference to Legislative Decree of 22 May 1999, no. 185, may exercise the right of withdrawal within 10 working days from receipt of the goods, returning AT HIS/HER OWN EXPENSES the purchased material, IN AN INTACT PACKAGE and complete with the original documentation of the goods and the fiscal documentation received with the goods themselves. Shipping costs are NOT REFUNDABLE.

To exercise the right of withdrawal, the following procedure shall be followed: the customer must contact IMC srl via email, indicating that he/she wishes to return the goods and providing his/her purchase details. We will then send a form to be completed. Once the document has been received, we will authorize the return, indicating to the customer the address to which the product must be shipped back. Upon receipt of the product by IMC srl and once its condition has been verified, we will proceed with the refund as defined.
For all further details on the right of withdrawal, please refer to the official Legislative Decree of 22 May 1999, no. 185.

For correct identification of the customer, during (authentication, account creation, registration) he/she must specify his/her tax status (VAT holder or private/consumer).

By email confirming his/her purchase order, the Customer unconditionally accepts and undertakes to observe, in relations with IMC srl, the general and payment conditions indicated below, declaring to have read and accepted all the information provided pursuant to the aforementioned regulations, also acknowledging that IMC srl is not bound by different conditions unless previously agreed in writing.

The General Conditions of Sale must be examined ONLINE by Customers visiting the IMC srl website before confirming their purchases. Submission of the order confirmation therefore implies full knowledge of these General Conditions of Sale and their full acceptance.

Once the online purchase procedure has been completed, the Customer undertakes to print and keep these general conditions of sale, already viewed and accepted during the purchase process carried out.

Customers are strictly prohibited from entering false and/or invented and/or fictitious data in the registration procedure necessary to activate the procedure for the execution of this contract and related communications; personal data and email must be exclusively their own real data and not those of third parties or fictitious persons.

Double registrations corresponding to a single company/consumer or entering third-party data are expressly prohibited. IMC srl reserves the right to take legal action against any violation and abuse, in the interest and for the protection of all consumers. The customer is therefore reminded to specify his/her tax status (VAT holder or private/consumer).

Any quote requests sent via email do not in any case represent an “executive sales order”.

Following such requests, IMC srl will act exclusively to provide the information that is the subject of said requests.

The purchase is made by the Customer and relates to the products available as illustrated and described ONLINE in the respective descriptive and technical sheets (Images are for illustrative purposes; the product may present aesthetic variations). All product prices are understood as VAT EXCLUDED or VAT INCLUDED depending on the choice on the portal.

Before confirming the purchase, the Customer will be given a summary of the unit cost of each selected product, the taxable amount, the VAT amount, the shipping costs and the total cost (excluding non-standard transport costs).

By confirming the purchase, the Customer can print the order data and will automatically receive by email the summary of the registered order.

Order validation is intended only if IMC srl confirms that the goods have been shipped. Advance payment for a supply does not necessarily justify an acceptance confirmation of the order; it may be refused by the company and refunded net of bank return operation costs.

Please note that the ordered goods depend exclusively on the customer’s will. Under no circumstances should they be refused, otherwise the round-trip shipping costs will be charged. If the customer does not reimburse the shipping costs within 15 days (notified by email), IMC srl will start legal proceedings against the customer. The online order is recognized as a regular commercial contract personally entered into by the purchaser.

Payment for the purchased products and related shipping costs must be made by the customer using the following methods: CREDIT CARD, BANK TRANSFER, PayPal or other tools available on the page.

Credit Card

Using a Credit Card on the Internet is just as safe, fast, easy and reliable as shopping in traditional stores. And with PayPal’s security, it is even better. Credit or prepaid cards from the VISA and MASTERCARD circuits are accepted, including American Express and Poste Italiane’s PostePay card.

Bank Transfer

Payment by Bank Transfer is subject to the following conditions: the bank transfer must be received within 2 working days from the order. Instant bank transfer allows prompt shipment if the material is available. After this date the order will be considered null. The reason for payment reported on the bank transfer must indicate: the order number and date, the purchaser’s company name or full name; the bank details are visible on the site in the “Orders in progress” section and are also reported in the order confirmation email automatically sent to the customer. It is understood that, if the bank transfer is chosen, the goods will be shipped only after the actual credit has been verified on our bank account. Given the current banking system, the amount transferred is credited to the beneficiary’s account no earlier than 1/3 working days from the date of the transfer. Sometimes, to further reduce the time required for the normal crediting of the Bank Transfer, it is sufficient to send us a copy of the receipt containing the CRO number of the transfer, as follows:

The availability of the products visible on the IMC srl website is close to 100%. Products purchased on the IMC srl website are delivered throughout Italy. The products purchased will be delivered by IMC srl via standard or express courier to the address indicated by the Customer as the destination address.

Goods travel on behalf and at the risk of the purchaser. Any claims for damage or tampering during transport must be submitted directly and in writing to the courier. Upon delivery, the customer must check the integrity of the packages and the quantitative and qualitative correspondence with what is indicated in the accompanying document. In case of discrepancies (missing packages compared to what is declared on the delivery document, open packages, damaged packages, etc.), this must be reported on the accompanying document and within 48 hours by email to vendite@industriemarine.it.

Product deliveries will take place on all working days. Delivery by IMC srl may be split at the explicit request of the customer, without this entailing any responsibility for IMC srl. If the ordered products are not in stock (even if available on the IMC srl website), the customer will be contacted by email or phone to be informed of the time required for the new delivery.

Indicatively, without this entailing any obligation for IMC srl and subject to market availability of the products and any force majeure, the goods will be delivered within the following times:

• with Bank Transfer, shipment will be entrusted to the courier within 24/48 hours from receipt of the email with the payment receipt;
  • with PayPal, shipment will be entrusted to the courier within 24/48 from receipt of the credit;
  An exception will be made for the islands, for which 72 hours are expected.

Delivery times are indicative and, in any case, valid provided there are no physical or structural impediments (for example: incorrect addresses or force majeure events). The transport contribution, to be added to the price of the products purchased, will be calculated automatically by the system.

It is possible that the package does not arrive within the time limits established or proposed on the website https://www.industriemarine.com/. In this case, the customer can contact customer service. IMC srl is not responsible for any direct or indirect damage or loss resulting from delayed or non-delivery of the product.

All products are covered by the manufacturer’s warranty, in accordance with the terms established by the latter. This warranty is limited to the item sold, excluding any other service as well as any compensation or indemnity.

This warranty will apply to the product that presents lack of conformity and/or malfunctions not detectable at the time of purchase, provided that the product itself is used correctly and with due diligence, i.e., in compliance with its intended use and what is set out in any technical documentation, in compliance with the various operating rules indicated therein.

IMC srl markets high-quality products, for which a minimum warranty of 12 months from the date of purchase is offered. Generally, such service is provided directly by the manufacturers of the goods sold. If the customer prefers, he/she may choose to be assisted by IMC srl in the return and management phases of the warranty return. For this purpose, and to allow IMC srl staff to properly perform the task, the customer must request support in advance by contacting IMC srl at the email address vendite@industriemarine.it. In any case, the reference legislation and the methods of applying the warranty are those indicated and highlighted by the manufacturer. Those who purchase material from IMC srl, by the very act of purchase, fully accept the manufacturer’s warranty conditions, which may be independent of IMC srl.

The above warranty will not apply in cases of negligence, carelessness in the use and maintenance of the product, connection of what is purchased to electrical systems or any other type of connection that does not comply with regulations.

The following provisions on Returns will be applied in two different cases:

1. In the event of an error by IMC srl in entering the order, shipping or delivery;
2. In the event that IMC srl decides at its discretion, or agrees with the customer, to apply more favorable terms for the customer.

Goods are returned ex our IMC srl warehouse. Unless otherwise instructed by the customer, shipment is carriage paid. The material travels at the customer’s risk and peril even if shipped carriage paid. Any complaints can only be accepted if notified by letter or email within eight days from the date of receipt of the material; after this period, any right to complain lapses.

General conditions for the acceptance of returns

For all products

• Submission of the withdrawal form
• Products not damaged
• Packaging and labels intact or in the same condition as supplied
• Products not purchased under a promotion, even if total return
• Products returned no later than one month from the date of receipt of goods

IMC srl will consequently reject any product returned without packaging, as well as products for which the return shipping costs have not already been fully paid by the Customer.

IMC srl will reject any product in the event that the return shipping costs have not already been fully paid by the customer; or in the event that the product has not been packed with original wrappings, or is not complete with every accessory, instruction manuals and everything originally included.

IMC srl will proceed to transmit the re-credit order relating to the cost of the goods shipped within 30 working days following the customer’s shipment of the goods and, in any case, not before receipt of the goods. The re-credit will be made by Bank Transfer, PayPal or credit card. The costs of returning the goods to the sender remain the responsibility of the Customer. NOTE: From the moment the customer opens the packaging, IMC srl declines all responsibility. All products (original packaging, accessories, instruction manuals and everything originally included) sent back by the customer will be checked by the “RETURNS SERVICE”, which takes on average 15 days to carry out a complete inspection.

The Customer also declares to be aware that the data provided are entered in the “IMC srl Customer Database” and may be used for promotional, commercial and sales purposes as well as for statistics by means of consultation, processing or comparison, or for sending editorial and/or promotional material, in accordance with the obligations imposed by Regulation (EU) 679/2016 (General Data Protection Regulation – “G.D.P.R.”).

This contract shall be governed by Italian law and, for any dispute relating to the validity, interpretation or execution of the same contract, the Customer accepts the jurisdiction of the Italian state and, in any case, the application of Italian law in force at the time of the dispute, regardless of his/her domicile or registered office, with the court of Pescara having jurisdiction.

IMC srl will make every reasonable effort to ensure the correctness and completeness of the information and data available on this site. Much of the technical information included on our website is based on data published by the respective manufacturers, which may be changed based on what is communicated to us by the manufacturers themselves even without notice. However, IMC srl does not guarantee and assumes no responsibility for the updating, correctness and completeness of the information provided on this site.
